1. Acceptance of these terms

By installing or using the WaSphere Shopify app (“the app”, “WaSphere”) you agree to these Terms of Service. If you are using WaSphere on behalf of a business, you confirm you are authorised to accept these terms for that business. If you do not agree, do not install or use the app.

2. What WaSphere does

WaSphere sends automated WhatsApp messages for your Shopify store — order confirmations, fulfillment and cancellation updates, abandoned-checkout reminders, auto-replies, storefront chat widgets, and bulk broadcasts you initiate. You connect your own WhatsApp account and configure which messages are sent.

3. Important disclaimer — unofficial WhatsApp connection

Please read this section carefully. WaSphere connects to WhatsApp as a linked device using an unofficial interface, not the official WhatsApp Business API. WaSphere is not affiliated with, endorsed by, or sponsored by WhatsApp or Meta. This approach has real risks you accept by using the app:

  • Account ban or block risk. WhatsApp may restrict, suspend, or permanently ban any number used for automated or bulk messaging, especially new numbers, high volumes, or messages recipients report as spam. We cannot prevent this and are not responsible for it.
  • Number warming. New WhatsApp numbers should be warmed up — start with low volumes and increase gradually, and only message people who expect to hear from you. Sending high volumes from a fresh number sharply increases the ban risk.
  • No guaranteed delivery. Because this is an unofficial connection, WhatsApp may change its platform at any time, which can interrupt or break message delivery without notice.
  • Use a number you can afford to lose. Do not rely on a personal or business-critical primary number if continuity matters to you.

You use WaSphere’s WhatsApp automation at your own risk. We do not guarantee that your number will not be banned, rate-limited, or otherwise restricted.

4. Your responsibilities

  • Consent and opt-in. Only message people who have opted in to receive WhatsApp messages from you. You are responsible for obtaining and recording that consent.
  • Legal compliance. You must comply with all applicable laws and with WhatsApp's and Meta's terms, including anti-spam, marketing, consumer-protection, and data-protection laws (such as GDPR).
  • Message content. You are solely responsible for the content of the messages you send and for honouring opt-out / stop requests promptly.
  • Accurate use. Do not use WaSphere for unlawful, deceptive, harassing, or abusive messaging, or to evade WhatsApp's restrictions.

You are the data controller for your customers’ information; WaSphere processes it on your behalf as described in our Privacy Policy.

5. Plans, billing, and message limits

WaSphere offers a free tier and paid plans with monthly message allowances. Paid subscriptions are billed through Shopify’s billing system and appear on your Shopify invoice. By choosing a paid plan you authorise Shopify to charge the recurring fee until you cancel or change plans. You can upgrade, downgrade, or cancel at any time from the app; changes take effect per Shopify’s billing rules. Message allowances reset each billing cycle and unused messages do not carry over.

6. Disconnection and termination

You may disconnect WhatsApp or uninstall WaSphere at any time; uninstalling stops message processing and cancels any active subscription going forward. We may suspend or terminate access if you breach these terms, misuse the app, or use it for unlawful messaging. On termination, we handle your data as described in the Privacy Policy, including the Shopify redaction webhooks.

7. Service availability

WaSphere is provided on an “as is” and “as available” basis. We do not warrant uninterrupted or error-free operation. Because message delivery depends on WhatsApp, an external service outside our control, we cannot guarantee that any given message will be delivered.

8. Limitation of liability

To the maximum extent permitted by law, WaSphere is not liable for any indirect, incidental, special, or consequential damages, or for lost profits, lost sales, lost data, or for any WhatsApp account suspension, ban, or restriction arising from your use of the app. Our total liability for any claim relating to the app is limited to the amount you paid us for it in the three months before the claim arose.

9. Changes to these terms

We may update these terms as the app evolves. We will revise the “Last updated” date above, and material changes will be communicated through the app. Continuing to use WaSphere after a change means you accept the updated terms.
